1. Changes to these Terms
We reserve the right to amend these Terms or to cancel, suspend or amend any Competition where this becomes necessary due to circumstances beyond our reasonable control or where required for legal or regulatory reasons.
Any changes will be published on our website or within the relevant Competition details.
2. Eligibility
Unless otherwise stated:
- entrants must be aged 18 years or over;
- entrants must have a valid UK postal address;
- only one entry per person is permitted; and
- entries must be received before the advertised closing date and time.
Employees, officers and agents of Michael O’Mara Books, together with anyone professionally connected with the Competition and members of their immediate families or households, are not eligible to enter unless expressly stated otherwise.
3. How to Enter
Each Competition will specify:
- how to enter;
- the opening and closing dates;
- any entry requirements;
- the prize(s) available; and
- any additional eligibility criteria.
Entries must comply with these Terms and any Competition-specific instructions.
Unless otherwise stated, no purchase is necessary to enter.
4. Entry Requirements
By entering a Competition, you confirm that:
- all information you provide is true, accurate and complete;
- your entry is your own original work (where applicable);
- you have obtained all necessary permissions from anyone appearing in or contributing to your entry;
- your entry does not infringe the intellectual property rights of any third party;
- your entry does not contain defamatory, discriminatory, offensive, obscene or otherwise unlawful material;
- your entry does not include another person’s personal information without their consent; and
- your submission does not contain viruses, malicious software or any material intended to interfere with the operation of our systems.
We reserve the right to request evidence of any permissions or consents where appropriate.
5. Disqualification
We reserve the right to refuse or disqualify any entry where we reasonably believe:
- these Terms have been breached;
- false or misleading information has been provided;
- the Competition has been manipulated or tampered with;
- automated or bulk entries have been submitted;
- an entrant has acted fraudulently or unfairly; or
- an entrant has behaved in an abusive, threatening or otherwise inappropriate manner towards Michael O’Mara Books, our representatives or other entrants.
Our decision regarding eligibility and compliance with these Terms shall be final.
6. Competition Prizes
Prizes are non-transferable, non-refundable and no cash alternative will be offered unless we decide otherwise.
If a prize becomes unavailable due to circumstances beyond our reasonable control, we reserve the right to substitute it with a prize of equal or greater value.
If an administrative, technical or printing error results in more winners being selected than prizes available, we reserve the right to withdraw incorrectly awarded prizes and conduct a further draw or allocate prizes fairly in accordance with applicable law.
7. Winner Selection and Notification
Where winners are selected at random, they will be chosen using a fair and impartial process.
Where winners are selected on the basis of skill, creativity or merit, entries will be judged according to the criteria published with the Competition.
Winners will normally be contacted using the contact details provided when entering the Competition.
Winners must respond and, where requested, provide any information reasonably required to arrange delivery of their prize within 7 days of being notified.
If a winner cannot be contacted, does not respond within 7 days, is found to be ineligible, or declines the prize, Michael O’Mara Books reserves the right to withdraw the prize and select an alternative eligible winner in accordance with these Terms.
If a prize is returned to us as undeliverable because incorrect contact or delivery details were provided, we reserve the right to treat the prize as unclaimed and select an alternative eligible winner.
8. Publicity
If you win a Competition, we may publish your first name and county (or another limited form of identification) for the purpose of announcing the winner and complying with our legal obligations.
If you object to this, please contact us. We will consider your request where appropriate, although we may still be required to provide winner details to regulatory authorities if requested.
9. Personal Information
Any personal information collected as part of a Competition will only be used for administering that Competition unless you have separately agreed to receive marketing communications.
Entering a Competition does not automatically subscribe you to our newsletters, and you are not required to sign up to our newsletters or other marketing communications in order to enter a Competition, unless this is clearly stated as part of the Competition and permitted by applicable law.
Where a Competition includes an optional opportunity to subscribe to our newsletters, your decision whether or not to subscribe will not affect your entry into the Competition or your chances of winning.
If you choose to subscribe to our newsletters, your personal information will be processed in accordance with our Privacy Policy.
We may use your postal address where necessary to send prizes, review copies or other promotional materials relating to the Competition.
Further information about how we collect, use and protect personal information can be found in our Privacy Policy.
10. Liability
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or any other liability that cannot legally be excluded.
Subject to the above, Michael O’Mara Books shall not be liable for any loss, damage, disappointment or expense arising from participation in a Competition or acceptance of a prize except where caused by our negligence.
We are not responsible for:
- entries that are lost, delayed or corrupted;
- technical failures affecting entry;
- website or network interruptions;
- prizes that are lost or delayed in transit where posted by a third party; or
- circumstances beyond our reasonable control that prevent the Competition from operating as intended.
11. Intellectual Property
Unless otherwise stated, entrants retain ownership of the copyright in their Competition entries.
By entering a Competition, you grant Michael O’Mara Books a non-exclusive, royalty-free, worldwide licence to use, reproduce, publish and display your entry for the purpose of administering and promoting the Competition and announcing the winners.
Where we wish to use an entry for any wider promotional purpose, we will seek your permission where appropriate.
12. Governing Law
These Terms are governed by the laws of England and Wales.
Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
